Customer Privacy Notice under the Turkish Personal Data Protection Law

1. 1.Identity of the Data Controller

   As Mizanplus Gıda Ticaret Anonim Şirketi (“Mizanplus” or the “Company”), providing our products and services in the best possible way is of great importance to us. Accordingly, in our capacity as data controller, we would like to inform you, within the scope of Law No. 6698 on the Protection of Personal Data (the “Law”), about the personal data of yours that we obtain.

2. 2.Processing of Personal Data and Purposes of Processing

   Although this may vary depending on the product, service or commercial activity offered by Mizanplus, your personal data is processed by our Company in order to ensure that products and services are provided in the best possible way. As Mizanplus, your general personal data, such as your identity and contact information, transaction security data, payment data relating to your purchases, visual data and audio data, and, if you provide them, your special categories of personal data, may be processed when you visit our Branches and Franchise branches, or through various channels (call center, website, live chat, mobile application, etc.), limited to the following purposes: providing our products and/or services; managing the receipt, cancellation and fulfillment of Orders; managing requests and complaints; where you have given your explicit consent and your permission for commercial communications, carrying out publicity, marketing, promotion, survey, prize draw, gift delivery, contest, campaign and advertising activities through various channels (website, social media platforms, mobile application, etc.), presenting general and special offers, conducting information and communication activities, and performing analyses in order to anticipate customers’ possible requests, so as to improve the quality of the services and products offered by our Company and to ensure customer satisfaction; managing our social media accounts and conducting the communications you establish with us through these channels; ensuring information and data security and the continuity of information systems; carrying out the work necessary to improve our products and services, and conducting reporting, analysis, internal control, audit, review and investigation activities; recording camera footage at our workplaces for the purpose of ensuring security; measuring and evaluating the quality of telephone calls conducted through the call center; fulfilling the requests of official authorities and institutions and implementing decisions communicated to our Company; conducting archiving and retention processes; and conducting and developing our Company’s activities and ensuring compliance with legislation.

3. 3.Transfer of Personal Data

   Your collected personal data may be transferred, for the purposes explained in Article 2 of this Privacy Notice and limited to the grounds requiring such transfer under the Law and the related regulations, to the information technology service providers whose services our Company uses; to agencies, the call center and other companies with which we cooperate; to the attorneys from whom we receive consultancy under contract; to official authorities and institutions; and to maintenance, solution and business partners.

4. 4.Method and Legal Basis of Collecting Personal Data

   Your personal data is collected for the purposes stated above, in accordance with the fundamental principles set out in the Law, based on and limited to the legal grounds specified in Article 5(2) of the Law, namely the performance of a contract, compliance with a legal obligation, being expressly provided for by law, and the legitimate interest of the data controller, by automated or non-automated means: from information you provide directly, verbally or in writing; from information provided through channels such as telephone and email; through our website and social media platforms; from the call center; from our branches and Franchise branches; from official authorities and institutions (the Consumer Arbitration Committee, etc.); through the applications and software used in the course of the Company’s activities and through camera recordings; and from business partners from whom support services are obtained.

5. 5.Your Rights Regarding Your Personal Data

   We would also like to remind you that, under the Law, you have the right to: learn whether your personal data is processed and, if it has been processed, request information about it; learn the purpose of the processing and whether the data is used by us in accordance with those purposes; know the third parties, within Türkiye or abroad, to whom the data is transferred; request its rectification if it is incomplete or inaccurately processed; request its erasure, destruction or anonymization if the reasons requiring its processing cease to exist; request that the third parties to whom the data has been transferred be notified of these actions or of the rectification; object if you believe that a result to your detriment has arisen from the analysis of the processed data exclusively through automated systems; and request compensation for any damage you suffer as a result of unlawful processing. Under the Law, you may submit your applications regarding your personal data to us: in person, with your identity verified, at the address Merkez Mah. Bağlar Cad. No:85a Kağıthane/İstanbul; or with your secure electronic or mobile signature, to our Company’s address info@mizanpluskitchens.com; or, with your identity verified, by the other methods set out in the KVK Law and the related legislation. In accordance with Article 13 of the Law, the Company will conclude application requests free of charge, depending on the nature of the request and within 30 (thirty) days at the latest. If a request is rejected, the reason(s) for the rejection will be explained in writing or electronically. If the process requires a cost, the fee schedule determined by the KVK Board will apply.
